1. LEGAL NOTICE

Website owner: G. Nogué
Tax Identification Number (NIF): 46415960M
Business address: C de Marí, Barcelona
Email: firm.casualwear@gmail.com
Website: thefirmway.com
The purpose of this website is the promotion and online sale of clothing and related products under the FIRM® brand.
Access to and use of this website implies acceptance of the applicable terms contained in this Legal page.
2. TERMS & CONDITIONS OF SALE
These Terms & Conditions govern purchases made through the FIRM® online store.
By placing an order, the customer confirms that they have read and accepted these Terms & Conditions and the applicable information regarding shipping, returns and privacy.
Products
FIRM® aims to display product descriptions, photographs, colours, sizing information and measurements as accurately as reasonably possible.
Minor differences in colour or appearance may occur depending on the customer’s screen, lighting or device and do not necessarily constitute a product defect.
The essential characteristics, available sizes and price of each product are displayed on its corresponding product page.
Prices
All prices displayed on the website are expressed in euros (€) and include applicable taxes unless expressly stated otherwise.
Any applicable shipping costs will be clearly indicated before the customer completes the purchase.
FIRM® reserves the right to change product prices at any time. Changes will not affect orders that have already been confirmed, except where required by law.
Placing an Order
To place an order, the customer must select the desired product and size, add the item to the cart, provide the information required for delivery and billing, select an available payment method and confirm the order.
Before completing payment, customers will have the opportunity to review the information entered and correct any errors.
Submitting an order that requires payment constitutes an obligation to pay the total amount displayed at checkout.
After the order has been successfully placed, the customer will receive an electronic confirmation.
The electronic information relating to the order may be stored by FIRM® for the periods required for contractual, accounting, tax and legal purposes.
Orders may be placed in the languages made available on the website.
Guest Checkout and Customer Accounts
Creating an account is not required to make a purchase.
Customers may purchase as guests or, where available, create an optional customer account.
Customers who create an account are responsible for keeping their login credentials confidential and for providing accurate and up-to-date information.
3. ORDERS & PAYMENTS
The payment methods currently available will be displayed during checkout.
FIRM® may use third-party payment service providers to securely process payments. Payment information may therefore be processed directly by the selected payment provider in accordance with its own terms and privacy policy.
FIRM® does not intentionally store complete payment card details on its own systems where payment is processed directly by an external payment provider.
Order Acceptance
Receipt of an order does not prevent FIRM® from cancelling it where there is a legitimate reason that makes fulfilment impossible or inappropriate, including:
- an evident pricing or technical error;
- lack of stock;
- suspected fraudulent or unauthorised activity;
- incorrect or insufficient delivery information;
- or circumstances that make fulfilment impossible.
If an order that has already been paid is cancelled by FIRM®, the amounts due will be refunded using the original payment method.
Nothing in this section limits any mandatory consumer rights.
4. SHIPPING & DELIVERY
FIRM® currently ships to European destinations made available during checkout.
Available delivery destinations may change and will always be shown before an order is completed.
Shipping Costs
Current standard shipping rates are:
Spain: €4.95
Other available European destinations: €9.95
The applicable shipping cost will be displayed before payment.
For destinations outside the European Union, where offered, customs duties, import taxes or other charges may apply. Any applicable charges and responsibilities will be handled in accordance with the law and the information provided during the purchasing process.
Delivery Time
Orders will be delivered as soon as reasonably possible and, unless a different period is expressly agreed with the customer, within a maximum of 20 days from confirmation of the order.
Delivery times may vary depending on the destination and carrier.
If FIRM® becomes unable to deliver within the agreed period, the customer will be informed and will retain all rights provided by applicable consumer law.
Customers are responsible for providing a complete and accurate delivery address.
5. RETURNS & REFUNDS
Right of Withdrawal
Customers have the right to withdraw from an online purchase within 14 calendar days from the day on which they, or a third party indicated by them other than the carrier, receive the goods, without having to provide a reason.
To exercise this right, the customer must clearly notify FIRM® of the decision to withdraw before the 14-day period expires.
Requests may be sent to:
After notifying FIRM®, the customer must return the goods without undue delay and no later than 14 calendar days after communicating the decision to withdraw.
Return Conditions
Items must be returned in the condition in which they were received.
Garments should retain their original tags and must not have been handled beyond what is reasonably necessary to establish their nature, characteristics and fit.
The customer may be responsible for any reduction in the value of a product caused by handling beyond what is necessary for these purposes.
Return Shipping Costs
When exercising the right of withdrawal, the direct cost of returning the goods is the responsibility of the customer.
The return address and instructions will be provided after the customer contacts FIRM®.
Customers are advised to use a tracked shipping method and retain proof of shipment.
Refunds
Where the right of withdrawal has been validly exercised, FIRM® will refund the payments received from the customer, including the cost of the least expensive standard delivery option offered for the original order, where required by law.
Any additional cost resulting from the customer choosing a delivery method more expensive than the standard delivery option will not be refunded.
Refunds will be made without undue delay and no later than 14 calendar days from the date FIRM® is informed of the customer’s decision to withdraw.
FIRM® may withhold the refund until the returned goods have been received or until the customer provides evidence that they have sent them back, whichever occurs first.
Refunds will normally be made using the same payment method used for the original transaction unless otherwise expressly agreed.
Size Exchanges
FIRM® currently does not offer direct size exchanges.
Customers who require a different size should return the original item under the procedure described above and place a new order if they wish.
Availability of another size cannot be guaranteed.
Defective, Damaged or Incorrect Products
The 14-day withdrawal policy does not limit the customer’s statutory rights relating to defective or non-conforming goods.
If a customer receives a defective, damaged or incorrect product, they should contact:
The customer should provide the order number and reasonable information regarding the issue.
Where the issue is attributable to FIRM®, FIRM® will bear the appropriate costs of resolving the matter in accordance with applicable law.
Goods sold to consumers are covered by the applicable legal guarantee of conformity, which for new goods under current Spanish law generally covers lack of conformity that becomes apparent within three years from delivery.
